Terms of Service

1. Acceptance of Terms

By accessing or using the SUCCESS Weight Loss Program portal ("Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Service. These Terms apply to all users, including patients, visitors, and any other individuals who access the Service.

These Terms are a legally binding agreement between you and Dr. Eskander's SUCCESS Program ("we," "us," or "our"). We reserve the right to update these Terms at any time. Continued use of the Service after changes constitutes acceptance of the revised Terms.

2. Description of Service

The SUCCESS Program is a structured 12-week weight loss and lifestyle coaching program developed by Dr. Eskander. The Service includes access to educational content, weekly modules, check-in tools, AI-assisted coaching, and optional direct communication with Dr. Eskander (Hybrid tier only).

Important: This Service is for educational and wellness purposes only. It is not a substitute for professional medical advice, diagnosis, or treatment.

Always seek the advice of your physician or other qualified health provider with any questions you may have regarding a medical condition. Never disregard professional medical advice or delay in seeking it because of something you have read or accessed through this Service.

3. Eligibility

You must be at least 18 years of age to use this Service. By using the Service, you represent and warrant that:

• You are at least 18 years of age.
• You have the legal capacity to enter into a binding agreement.
• You are not prohibited from using the Service under applicable law.
• All information you provide is accurate, current, and complete.

4. Subscriptions, Free Trial, and Billing

4.1 Free Trial

We offer a 7-day free trial for new subscribers. A valid payment method is required to start the trial. Your card will not be charged during the trial period. If you do not cancel before the trial ends, your subscription will automatically convert to a paid subscription and your payment method will be charged.

4.2 Cancellation

You may cancel your trial or subscription at any time before the next billing date by accessing Account & Settings → Subscription & Billing → Manage Billing. Cancellation takes effect at the end of the current billing period. No refunds are provided for partial billing periods unless required by applicable law.

4.3 Pricing

Current pricing is displayed on the program enrollment page. We reserve the right to change pricing with at least 30 days' notice to existing subscribers. Price changes will not affect your current billing period.

4.4 Payment Processing

All payments are processed securely through Stripe. We do not store your full card number or CVV. By providing your payment information, you authorize us to charge the applicable fees to your payment method.

5. Health Information and Privacy

The health information you provide through the Service is handled in accordance with our Privacy Policy, which is incorporated into these Terms by reference. We are committed to protecting your health information in compliance with applicable privacy laws.

By using the Service, you consent to the collection, use, and disclosure of your health information as described in our Privacy Policy. You have the right to access, correct, and request deletion of your health data at any time through Account & Settings.

6. User Conduct

You agree not to:

• Use the Service for any unlawful purpose or in violation of these Terms.
• Share your account credentials with any other person.
• Attempt to gain unauthorized access to any part of the Service.
• Upload or transmit any harmful, offensive, or infringing content.
• Use the Service to harass, abuse, or harm any person.
• Reverse engineer, decompile, or disassemble any part of the Service.
• Use automated tools to scrape, crawl, or extract data from the Service.

7. Intellectual Property

All content on the Service, including but not limited to the SUCCESS curriculum, videos, worksheets, guides, and AI coaching content, is owned by or licensed to Dr. Eskander's SUCCESS Program and is protected by copyright, trademark, and other intellectual property laws.

You are granted a limited, non-exclusive, non-transferable license to access and use the Service content for your personal, non-commercial use during your active subscription. You may not reproduce, distribute, modify, or create derivative works from any Service content without our express written permission.

8. Disclaimers and Limitation of Liability

THE SERVICE IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS.

Individual results from the SUCCESS Program will vary. Weight loss results depend on many factors including, but not limited to, starting weight, adherence to the program, individual metabolism, and medical conditions. No specific results are guaranteed.

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, WE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF THE SERVICE.

9. Termination

We reserve the right to suspend or terminate your access to the Service at any time, with or without notice, for conduct that we believe violates these Terms or is harmful to other users, us, or third parties. Upon termination, your right to use the Service will immediately cease.

You may delete your account at any time through Account & Settings → Preferences → Delete My Account. Account deletion is permanent and irreversible.

10. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the State of California, without regard to its conflict of law provisions. Any dispute arising from these Terms or your use of the Service shall be resolved through binding arbitration in accordance with the American Arbitration Association's rules, except that either party may seek injunctive or other equitable relief in any court of competent jurisdiction.
